Jade Ijada

Terms and conditions of sale

What you are buying, from whom, on what terms, and what your rights are. Written to be read, not to discourage reading.

Article 1

Purpose and acceptance

These terms govern every sale concluded on jade-ijada.com between the publisher of the site and a consumer buyer. Confirming an order amounts to accepting these terms in the version online at the time of the order. They are accessible at any moment from the footer and from the checkout, and a copy is attached to the order confirmation.

Article 2

The seller

Jade, a natural person trading in Estonia under the entrepreneur account scheme (ettevõtluskonto), an activity not registered with the Estonian commercial register and not subject to VAT.

Business address: Tartu mnt 52, 10115 Tallinn, Estonia. Contact: contact@jade-ijada.com. Full details in the legal notice.

Article 3

The jewellery and objects sold

The pieces sold are jewellery and objects in jade, that is in jadeite or in nephrite, set on sterling silver, on gold plated metal, or carved from the block. The mineral is named on every product page. A piece that is neither jadeite nor nephrite carries its real mineral name and the word jade does not appear in its title.

The variations of a natural material

Jade is a natural stone, and two pieces from the same listing are never identical. The shade of green, the distribution of the veining, the fineness of the grain, the presence of milkier or more translucent zones vary from one piece to another. The photographs are taken on a reference example, in daylight and without colour retouching; a screen adds its own variation.

These differences in shade do not constitute a defect. A mineral different from the one stated, a dimension different from the one published or a metal different from the one indicated are defects, and fall under article 9.

The published measurement, and its scope

When a stone arrives bare, one example of the listing is weighed by the hydrostatic method and the result is published on the product page with its date. That measurement concerns the reference example, not the piece shipped. It establishes the mineral. It constitutes neither a certificate nor an expert appraisal, and engages the liability of no laboratory. The method and its three limits.

Treatments

In accordance with article 10 of French decree no. 2002-65 of 14 January 2002 on the trade in gemstones and pearls, a treatment information sheet is made available to the buyer before the sale and supplied with the invoice.

The treatment status of the pieces sold is not determined: the supplier does not know it, and weighing does not reveal it. No piece is therefore presented as untreated, nor as falling within grade A. The buyer is invited to treat every piece as if it might be impregnated: no ultrasound, no steam, no solvent, no heat source.

Article 4

Prices

Prices are shown in euros, all taxes included. No VAT is charged, the seller not being subject to it. Postage is added to the price of the items and is shown before the cart is confirmed.

Prices may be changed at any time; the applicable price is the one displayed at the time of the order. Any customs duties and import taxes outside the European Union remain payable by the recipient.

Article 5

The order

The buyer chooses their items, checks the contents and the total amount of their cart, enters their details, reads these terms and then confirms the order. Confirmation constitutes a commitment, and it is for the buyer to check the summary before confirming.

A confirmation email summarizes the order. An order may be refused for a legitimate reason, in particular where stock has run out or where there is a payment anomaly; the buyer is then informed and refunded in full.

Article 6

Payment

Payment is made online at the time of the order, by bank card or through the payment services offered at checkout. Payment is handled by a specialist provider: no banking data passes through this site or is stored on it. The detail of the processing.

The order is dispatched only once payment has actually cleared.

Article 7

Delivery

Items are dispatched to the address given by the buyer. Costs and zones are detailed on the Delivery and returns page, and the exact amount is displayed in the cart before any payment.

The seller undertakes to dispatch within 48 hours of the order being confirmed, for delivery within 14 days from dispatch. Over and above that undertaking, the law sets a ceiling: the delivery time may under no circumstances exceed thirty days from the order. After that time, the buyer may give the seller formal notice to deliver, then cancel the order and obtain a full refund of the sums paid.

The carrier varies by destination. Where a parcel is damaged, the buyer is invited to photograph the packaging before opening it and to report the incident.

Article 8

Right of withdrawal

The consumer buyer has fourteen days from receiving their order to withdraw, without having to give a reason and without penalty. Where delivery is staggered, the period runs from receipt of the last item.

Withdrawal is exercised by an unambiguous statement sent to contact@jade-ijada.com. No particular form is required. Items must be returned within the fourteen days following that statement.

The refund is made at the latest fourteen days after being informed of the decision to withdraw, by the same means of payment, and includes the original postage at the standard rate. Return postage remains payable by the buyer, except where the return is prompted by a lack of conformity.

Express waiver of an exception provided by law. Consumer law allows withdrawal to be excluded for goods made to the consumer’s specifications or clearly personalized. The seller does not rely on that exception. A piece chosen, set or sized for a buyer remains returnable on the terms above.

The buyer may be held liable for any depreciation resulting from handling other than what is necessary to establish the nature and characteristics of the goods.

Article 9

Legal warranties

All pieces benefit from the legal warranties, independently of any commercial warranty, and at no cost to the buyer.

Legal warranty of conformity
Two years from delivery of the goods. It covers lacks of conformity existing at delivery: the goods must match the description given and present the qualities announced. The buyer chooses between repair and replacement, and may obtain a price reduction or the cancellation of the sale if neither of those solutions is possible.
Warranty against hidden defects
Two years from the discovery of the defect. It covers hidden defects that make the goods unfit for their use or that so diminish that use that the buyer would not have acquired them. The buyer may return the goods and have the price refunded, or keep them and have part of the price returned.
How to invoke them
A message to contact@jade-ijada.com with the order number and a photograph is enough to open the file. No proof of purchase other than the order confirmation is required.

What the warranties do not cover

It is more honest to write it than to let it be discovered:

  • normal wear of a piece that is worn, including the polish softening over time;
  • the darkening of silver, which is a natural oxidation of the metal and comes off with a cloth;
  • breakage from impact or a fall: jade is tough but it is not unbreakable, and a thin edge chips;
  • damage resulting from cleaning contrary to the recommendations, in particular by ultrasound, steam, alcohol or household product;
  • the slackening or breaking of a thread on a bead strand after prolonged use, which is a matter of routine restringing.

The care recommendations form part of these terms.

Article 10

Liability

The seller is responsible for the proper performance of the obligations arising from the contract. Their liability cannot be engaged in the event of force majeure or of the unforeseeable act of a third party.

No piece sold is a medical device. No effect on health, pain, fertility or mental state is claimed, and the site’s content relating to traditions is reported as cultural material. The medical disclaimer forms part of these terms.

Article 11

Personal data

The data collected is necessary for processing the order and for the relationship with the buyer. It is neither sold, nor rented, nor transferred. The purposes, the legal bases, the retention periods, the processors and everyone’s rights are detailed in the privacy policy.

Article 12

Disputes and applicable law

These terms are subject to the law of the seller’s country of establishment. This clause in no way deprives the consumer buyer of the protection afforded by the mandatory provisions of the law of their country of habitual residence within the European Union.

If there is a difficulty, write to me first: most situations are settled in two messages. If the answer does not suit, two free routes of recourse exist:

  • the European Consumer Centre of the buyer’s country of residence, which handles cross border disputes within the Union;
  • the consumer protection authority of the seller’s country of establishment, whose details can be requested at any time.

None of these steps deprives the buyer of their right to bring the matter before the competent court.

These terms may change. The applicable version is the one online at the time of the order, and it is attached to the confirmation.
